Unmaid Hospital Case Makes Drug Manufacturers Wary


The recent case at Jodhpur's government-run Umaid Hospital seems to have made the entire Indian drug manufacturers feel very uneasy.

The reason for the uneasiness arises from the criminal case which has been filed against the drug manufacturer by the local police. The company along with its distributor has been booked under Section 328 which implies "causing hurt by means of poison, etc., with intent to commit and offence”.

The sections reads, “causing hurt by means of poison, etc., with intent to commit and offence. Whoever administers to or causes to be taken by any person any poison or any stupefying, intoxicating or unwholesome drug, or other thing with intent to cause hurt to such person, or with intent to commit or to facilitate the commission of an offence or knowing it to be likely that he will thereby cause hurt, shall be punished with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine."

The industry believes that such cases should be booked under the Drugs and Cosmetic Act. Under which, the Drugs Controller General of India (DCGI) approaches a court and requests prosecution under the offences and penalties clause of the Drugs and Cosmetics Act.

A senior counsel Kapil Dave said,"An act like this would mean that all pharma companies should be scared of supplying to government hospitals since they are governed by the state governments. Section 328 would tantamount to pharma companies CEO being hounded as criminal killers by anyone."

“The drug industry has been closely following the developments in this case and would decide on the future course of action” said SK Singhal of a leading pharma company from Northern India.

Government Hospitals in India—A sorry state of Affairs.
Five years ago I read the news doing rounds that a patient that underwent tubectomy at a south India’s government hospital died of complications. It later was learnt that it was a case of Human Error. While the court gave its verdict in this and many other such cases and I would not choose to comment on any verdict or ruling, what remains juxtaposed over so many years is the extremely poor rather neglected conditions in the government hospitals.
While currently there as been some kind of a drive in the nation to expose various scams, whether they be in realty or telecom, we tend to treat hospital experiences as each to his own. In the post independence era about 40 yrs ago the infant and the maternal mortality rate was high and looked ever increasing. While the private healthcare practice has flourished to a large extent in the metros, the healthcare available to the masses yet remains the same. With the costs of treatments and drugs having skyrocketed the mortality indicators remains the same.
All fingers currently get pointed to the recent incident of 14 deaths in the labor ward/ OT of a government hospital at Jodhpur. While the investigations as always will take their own course and the legal machinery burn the midnight oil, what appears to be getting lost are the larger perspective and the real issues that threaten the building of a healthy nation and our staring in the face of the various awareness campaigns led by the ministry of health and Family welfare. It is a clear indication that the current functioning of most of the government and public hospitals is not up to the expectation especially availability, technology and quality.
Until now the investigation and the hospital committee has been stating the contaminated IV fluid as the cause of deaths. Maybe or maybe not still remains undecided.
Dr. Arun Agarwal, a renowned oncology surgeon of the country, who has gathered experience through his practice of the last 27 yrs, including the prestigious Tata Memorial hospital, Mumbai is disturbed at the prevailing situations and strongly states that in his long work experience he has never faced any situation where post operative deaths may have occurred due to administration of IV fluids as is being pointed out in the case at the Jodhpur hospital. IV fluids are a purchase of the hospital and not of any particular ward. Nevertheless, to understand what may be the cause of such deaths, we need to assess the current hygiene conditions in Government hospitals across the country. The problem lies when all investigations are looking towards a temporary situation and not the long term fixation.
Hygiene and Sanitization can be categorized into several levels at any hospital. It begins with personal hygiene of OT staff to Hygiene audits of equipment and the various wards. Unfortunately it is the most neglected at all stages and can result in extreme situations of infections and culminate into deaths. The septic conditions of hospitals in villages is unaccounted for, it is intentionally neglected in the city government hospitals.


Dr. Arun points out that lack of Trained OT staff is one of the key aspects that leads to negligence as understanding and thereby turnaround time to serious situations gets reduced. There is commonly seen a lack of technological advanced equipments and knowledge of its usage. As per regulatory bodies and the norms laid down by the Government itself the sterilization of the wards and Operation theatres is a stringent process. It calls for hospital audits at regular intervals. Audits are not a reference to accounts here, instead it implies to swab cultures that may be retained form various facilities to rule out hospital ward functions. One can refer to the Indian public Health Standards report commissioned by the Ministry of Health and Family welfare. “
Drugs are essential for all acute conditions and emergencies. But if they are resulting in an infection, it results in drug induced side-effects – which are can get dangerous and can be handled if the response time is quick not as slow as waiting for 14 deaths to happen.
Another renowned gynecologist of the country Dr. Shailja Tyagi strongly refutes that the 14 deaths being reported could have been due to contaminated IV fluids. It’s hard to believe she says, especially when we all know and can see the failing conditions at all fronts in our government hospitals. The staff lacks the human touch that is required in the profession and therefore lacks accountability of indentifying the real problem or causes. IV Fluid contamination results in shivers, high grade fever which can be controlled with counter drug management. It rarely or never results in deaths.
A maternity ward is considered as one of the most vulnerable wards and can be prone to infections from the slightest negligence in equipment or the beds and the staff handling the patients. In her work experience abroad she observes that while hospital audits are an inbuilt phenomenon in the healthcare practice globally, in India they are an absolutely ignored space. An obvious why in a situation like so many as above we seek vendors and suppliers as soft targets rather than identify the real causes. While there may be a committee investigating it is important that they focus on the hygiene factors in the labor ward. An absence of a centralized sanitization system for equipments, the right levels of research pathology labs may be causes that led to the situation.
Whatever may have been the reason for the deaths what clearly stands are the safety hazards and the hygiene in government is highly overlooked. It’s time the investigations direct towards the larger issues. We need to think beyond the blame game and take responsibility of the systems we set up and rules we define for ourselves. Perhaps the most important factor that will change the sorry state of the public medical system is pressure from the public. It would be wonderful, however, if doctors were a part of the move for change.

नया हरसूद के रहवासियों की आखों में आज भी डूबते हुऐ हरसूद की यादें ताज़ा हैं। 15 वर्ष पूर्व इन्दिरा सागर हाईडल परियोजना की डूब में आने के कारण हरसूद के रहवासियों को जबर्दस्ती विस्थापित किया गया था। इन विस्थापितों का जीवन आज भी पीड़ाओं से भरा हुआ है। इन विस्थापितों को अपने कच्चे मकानों से हटा कर नये हरसूद के पक्के मकानों में शिफ्ट किया गया था। विस्थापन के बाद इन लोगों को पता चला कि पक्के मकानों के अलावा अन्य वादों के मुताबिक सुविधायें एकदम शून्य।

इन विस्थापितों को आज भी पछतावा हो रहा है। विस्थापन के वक्त दी गई अल्प सुविधायें भी रख-रखाव के अभाव में खत्म हो चुकी हैं। अब सरकार भी इन सुविधाओं के रख-रखाव में आलसी रवैया अपना रही है और विकास कार्य ठप्प पड़े हैं।

आमतौर की तरह दलालों और सरकारी अधिकारियों ने विस्थापन के दौरान जमकर फायदा उठाया और हरसूद के गरीब वासियों को और ज्यादा गरीबी में छोड़ दिया। पूर्व के हरदूसर विस्थापन से सबक लेते हुये और सरकारी ऐेजेन्सीयों के लैतलाली भरे रवैये को परखते हुये महेश्वर हाईड्रो इलेक्टिªक प्रोजेक्ट अधिकारियों ने विस्थापन हेतु चुने हुऐ गांवों की आबादी की विस्थापना की पूर्ण योजना में इन्हें शामिल किया है।

विस्थापन का कार्य व्यवस्थित रूप से इस 400 मे.वा. महेश्वर हाईडिल प्रोजेक्ट में किया जा रहा है। विस्थापन का कार्य एक-एक गांव करके किया जा रहा है और बाकी गांव वासियों को इस प्रक्रियां में सम्मिलित किया जा रहा हैं। कई गांव वासियोंने व्यवस्थापन स्थल पर बड़े पक्के मकान बना लिये हैं और इज्जत की जिन्दगी जी रहे हैंं। ये मकान इनकी दो कमरे के टपरों से बहुत बड़े हैं परिवार के सदस्यों के पास अब अलग-अलग कमरे हैं और घर के अन्दर ही टायलेट हैं। अब इन्हें शौच हेतु खेतों में भी नहीं जाना पड़ता है।


राम सिंह केवट व उनका परिवार आज पांच कमरे के मकान में रह रहें है। उनके विवाहित पुत्र के लिये अलग से कमरा है। राम सिंह और उनकी पत्नी मास्टर बैडरूम में रहते है और उनका एक अविवाहित पुत्र भी एक अलग कमरे में रहता है। शाम को पूरा परिवार एक साथ हाल में चाय, नाश्ता करते हैं। एक साफ रसोई में सबका खाना बनता है। परिवार कई सालों से एैसे साफ वातावरण में रहने का सपना देख रहा था। नानू भी हाल ही में अपने परिवार के साथ विस्थापित हुआ है। वह शाम से वैध पक्के मकान में रह रहा है जहां पर बिजली है और घर में ही नल का पानी आता है। नानू ने बताया कि अब उसका परिवार बहुत खुश है। पहले बारिशों में गॉंव में पूरी कीचड़ भर जाती थी। और शौच के लिये परिवार वालों को अन्धेरे में दूर खेतों में जाना पड़ता था।

लेपा, पीताबाली, बाहेगांव, जालोद, तेलियान के रहवासी भी अब खुशी से रह रहे हैं।

Pain saga continues at New Harsud

A decade and half is over but the flashes of helplessly watching their homes submerge in
Narmada are still as fresh in the eyes of Harsud residents as if it happened yesterday. For them,
the time has stood still since the ill fated moment when these villagers living in the vicinity of
Narmada River’s Indira Sagar Hydel Project were forcefully shifted to the newly constructed
houses at New Harsud. Although devoid of modern facilities, the mud houses had been their
habitat for generations.

Lured to shifting into better Pukka Houses, these unfortunate migrants were forced into a new
Pukka house colony with practically all facilities either missing or grossly miss spelt. Even today,
these shifted villagers are in no good state of affairs. The earlier provided minimum facilities too
have deteriorated with passage of time and ignorance of government agencies to restore and
retain facilities developed for these unfortunate poor.

However, not so surprisingly, the ultimate beneficiary of this transition from old to new Harsud
has been the middlemen and government officers. As customary they have managed to spin
some fortune for themselves out of this while poor have turned poorer.

Today, taking note of past inhuman experiences of callous attitude of government agencies
during rehabilitation of Harsud villagers, the Maheshwar Hydro Electric Project authorities (a
PPP project promoted and driven by the MW Corp Group) have thoughtfully chosen a well
planned and developed rehabilitation site. The district administration, state administration and
the Project authorities have actively involved the affected villagers in the entire process of site
development.

Rehabilitation of displaced villagers is being done stage wise in this 400 MW Maheshwar Hydel
Project. Single villages are being shifted and residents of other villages are witness to the
process. As many villagers have already built huge Pukka houses and leading a life of dignity.
Much larger than their two room huts back in the village, now most of the family members have
separate rooms to live in the same house. They have toilets for natural calls rather then the old
practice of going outside in farmlands.

Ram Singh Kewat of Lepa who shifted to his newly constructed house, owns a five room house
today. His married son has a separate bedroom, he and his wife resides in the master bedroom
while another unmarried son also has a separate room. Now they have privacy of married life.
The entire family assembles in a common room and takes meals together where meal is cooked
in a separate clean kitchen, is almost the life they dreamt for ages.

Nannu also shifted to the colony recently. He is proud to have the Pakka house with a legal
electricity connection, water at his door step and clean constructed streets for morning walks.
Life suddenly has turned so comfortable, he says. Recalling old days, he says women of the
family faced much problems during monsoons when there was marsh all over and they had to
go long distances in dark for toilet. It was not safe due to poisonous snakes and insects and also
faced many other social problems. Today, they live with respect.

Many other villagers including Lepa, Pitabali, Bahegaon, Jalud, Telyaon, also live happily.
Earlier, we could not believe what officers said, but today we are happy we shifted.
